Protecting Your Parental Rights
Child custody is probably one of the most heated issues when it comes to
divorce and
family law disputes. This is due to the fact that it impacts the relationship between
a parent and his or her child. While some parents are able to come to
their own child custody agreements, others end up in vicious courtroom
battles. Whichever type of situation you are in, you need a strong and

a parent, as well as the wellbeing of your child or children. Fortunately,

What is child custody?
When you are seeking a custody agreement or judgment, there are two forms
of child custody that you need to consider—physical custody and
legal custody. Physical custody governs which parent the child will live
with (either one parent or both). The parent with physical custody provides
supervision for the child and takes care of his or her day-to-day needs.
Legal custody governs the parent's right to make key decisions that
affect the child's life, such as decisions of where the child will
go to school or what type of medical care he or she will receive. Child
custody may be granted completely or mostly to one parent (sole or primary
custody), or it may be granted to both (joint custody).
How is child custody determined?
When the court has to make a child custody and/or visitation decision,
it considers a number of different factors. A few of these includes how
close the child is to each parent, the ability of each parent to take
care of the child, the health and age of the child, the child's ties
to his or her current living environment, any history of domestic violence
or drug/alcohol problems, etc. If the child is old enough and mature enough,
his or her preference may even be taken into consideration. In order to
improve your chances of obtaining a favorable child custody order, you
will need a skilled lawyer who can present a convincing argument to the
court explaining why you deserve custody.
